BMW driver from Belvedere banned for 12 months after drink-driving in Ashford

A BMW driver spotted moving in-between lanes and then failing to make off from a traffic light was found to be over the legal limit.

Shahair Fagueira was at the wheel of his BMW in Ashford town centre when he came to the attention of officers in a patrol car.

They witnessed him going the wrong way in a left-turn only road at just 15mph in a 30mph zone and as he moved between lanes they became suspicious he may have been drinking.

The officers followed and then as Fagueira was waiting at a set of traffic lights and they turned green, he failed to pull off from them, so the officers decided to pull him over.

When they spoke to him, he had slurred speech so they asked him to do a roadside breath test, which he failed.

The 28-year-old was stopped in Station Road on January 15 and gave a reading of 57 microgrammes of alcohol in 100 millilitres of breath, the legal limit is 35.

Fagueira, of Draper Close, Belvedere, was arrested and later charged with drink-driving and admitted the offence when he appeared at Folkestone Magistrates' Court on February 15.

Defending himself, Fagueira said: "I had a couple of beers. I made a stupid decision, it's a massive mistake.

"I will lose my job because of the distance I have to travel. I've not spoken to my boss about it yet, I was waiting to see how it (the court case) would go."

District Judge Justin Barron fined Fagueira £400 and banned him from driving for 12 months.

Fagueira was also ordered he pay a victim surcharge of £160 and £85 court costs and if he completes a drink-driving course, his ban will be reduced by a quarter.

Judge Barron said: "You sound sensible, this was a bad decision which was clouded by what you'd had to drink."
